Terms and Conditions

These Terms and Conditions (the “Terms and Conditions”), including the Privacy Policy and other documents referred to herein (the “Agreement”), constitute a legal agreement between you (hereinafter, “you” or “your”) and Jameati (“Jameati,” “we,” “us,” or “our”), respecting your use of the Services as described herein.

BY INDICATING YOUR ACCEPTANCE BY CLICKING ON THE APPROPRIATE BUTTON WHEN SIGNING UP FOR THE SERVICES, OR BY OTHERWISE USING THE SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT ACCEPT AND AGREE TO BE BOUND BY THE AGREEMENT, DO NOT ACCESS OR USE THE JAMEATI SOLUTION.

  1. Definitions

In these Terms and Conditions:

  • “Access Information” has the meaning set out in Section 6.
  • “Agreement” has the meaning set out in the first paragraph of these Terms and Conditions.
  • “Applicable Law” means any domestic or foreign law, rule, statute, regulation, ordinance, code, guideline, or judicial, administrative, ministerial, or departmental judgment, award, decree, or other requirement or guideline published or in force at any time during the term of this Agreement which applies to or is intended to govern or regulate any person (including any Party), property, transaction, activity, event, or other matter, including any rule, order, judgment, directive, or other requirement or guideline issued by any Governmental or Regulatory Authority.
  • “Application” has the meaning set out in Section 2(b).
  • “Confidential Information” means information considered confidential or proprietary by Jameati, including the Jameati Solution, business plans and strategies, designs, prototypes, compilations of information, data, programs, methods, inventions, techniques or processes, information relating to any Jameati service, software, website and web platform, client and user information, financial information, marketing information, intellectual property, business opportunities, or research and development.
  • “Content” has the meaning set out in Section 2(a).
  • “Governmental or Regulatory Authority” means any national, federal, emirate-level, local, municipal, quasi-governmental, or self-regulatory department, authority, organization, agency, commission, board, tribunal, bureau, official, minister, or court or other law, rule, or regulation-making entity having or purporting to have jurisdiction over Jameati, you, or any other person, property, transaction, activity, event, or other matter related to this Agreement.
  • “Party” means each of Jameati and you, and “Parties” means Jameati and you collectively.
  • “Personal Information” means information about an identifiable individual.
  • “Privacy Policy” has the meaning set out in Section 4(e).
  • “Program” means a study program, including academic programs offered by educational institutions.
  • “Recruiter” means any individual or entity that you engage to represent you to submit an Application using the Jameati Solution.
  • “Services” has the meaning set out in Section 2.
  • “Submission” has the meaning set out in Section 11.
  • “Terms and Conditions” has the meaning set out in the first paragraph of these Terms.
  • “Your Data” has the meaning set out in Section 4(a).
  1. Services

Jameati’s services described in this Section 2 (collectively referred to as the “Services”) consist of the following:

(a) Content Access: Jameati will provide access to certain information, material, or content (including pricing, features, promotions, and information of third parties) contained on or provided through the Jameati website (the “Content”) to assist you through the process of becoming a student at certain educational institutions, including Program information.

(b) Application Facilitation: Jameati will provide you with the ability to input Your Data into the Jameati Solution and will act as an intermediary to pass Your Data to the applicable educational institutions to enable you to apply to Programs offered by such institutions (each, an “Application”).

(c) Support Services: Jameati will facilitate an Application by assisting you with communications with the applicable educational institutions, processing Application fees and other payments associated with an Application, and providing guidance and advice associated with an Application.

  1. License to Use the Jameati Solution

Subject to the terms and conditions in the Agreement and any restrictions contained in the Content, Jameati hereby grants you a personal, non-exclusive, revocable, non-transferable license to access the Jameati Solution solely for the purposes of using the Services, viewing the Content, and submitting an Application to educational institutions.

  1. Your Data

(a) Your Data Must be Complete and Accurate

To use the Jameati Solution, you must:

  • (i) Provide up-to-date, complete, and accurate Personal Information or other data submitted by you to the Jameati Solution or otherwise provided to Jameati, including name, contact information, citizenship and legal status, gender, date of birth, address, marital status, emergency contact information, financial information, educational qualifications, employment information, transcripts, test scores, passport details, and any information required for visa applications, including financial and medical information (“Your Data”), as requested by Jameati on its website and as required to process your Application.
  • (ii) Where payment is required, provide up-to-date, complete, and accurate payment information as required by Jameati or its third-party payment processor, as applicable (which may include a valid PayPal or Stripe account, or credit card information for a credit card that is valid and legally registered to you).
  • (iii) OBTAIN ALL RELEVANT PERMISSIONS FROM ANY AFFECTED THIRD PARTY, such as your educational institution, for Jameati to collect Your Data.

(b) Ownership of Your Data

Nothing herein transfers any ownership of Your Data to Jameati in its original form.

(c) Quality of Your Data and Feedback

  • (i) Jameati does not assess Your Data for quality or otherwise. Educational institutions and other third parties to whom Jameati is permitted to pass Your Data under this Agreement may rely on the accuracy of Your Data provided by you to the Jameati Solution.
  • (ii) Any feedback that you receive respecting Your Data is not the result of any specific examination of the data by Jameati, or any judgment exercised by Jameati respecting Your Data, but rather is solely based on the compliance requirements of educational institutions.

(d) Consent to Processing of Your Data

An integral part of the Jameati Solution entails the collection, processing, transmission, and disclosure of Your Data by Jameati, educational institutions, and their service providers. You hereby specifically consent to:

  • (i) Jameati’s provision of Your Data to any educational institution, visa agencies, test score organizations, professional bodies, service providers to Jameati (including our hosting providers), and Governmental or Regulatory Authorities as part of the provision of the Jameati Solution to you.
  • (ii) Communications from Jameati (including e-mail communications, both marketing and informational) respecting the Jameati Solution and Jameati’s products and services.

(e) Privacy Policy

Your Personal Information will be handled in accordance with Jameati’s Privacy Policy accessible via the following link: [Insert Privacy Policy Link] (the “Privacy Policy”). Notwithstanding the foregoing, Jameati reserves the right at all times to disclose any Personal Information as it deems necessary to satisfy any Applicable Law, legal process, or requirements of a Governmental or Regulatory Authority.

(f) Storage of Your Data in Other Jurisdictions

You acknowledge that, due to the nature of the Jameati Solution, Your Data uploaded to the Jameati Solution may be hosted on servers residing in jurisdictions other than the United Arab Emirates, over which Jameati has no direct control. By using the Jameati Solution, Your Data may become, during the period that Your Data is hosted on such servers, subject to the Applicable Laws of the jurisdiction in which such servers reside or to the terms of agreements respecting the hosting of data on such servers.

  1. De-Identified Data

Jameati may also use, or provide to third parties, Your Data and any data regarding your use of the Jameati Solution in aggregated form, in a manner that does not identify you (“De-Identified Data”), subject to Jameati’s Privacy Policy. This is for Jameati’s business uses, including enhancing and fixing the Jameati Solution, performing analytics, marketing the Jameati Solution to third parties, and selling such De-Identified Data for profit. Jameati will own any and all intellectual property rights in the output of Jameati’s use of any such De-Identified Data.

  1. Your Access Information

Jameati will provide you with certain information to allow you to use the Jameati Solution, such as one or more user IDs and passwords and/or the ability to create user IDs and/or passwords (“Access Information”). The Access Information is personal to you; you will not permit anyone other than you or your authorized representatives to obtain access to the Jameati Solution using the Access Information.

  1. Your Representations and Warranties

You covenant, represent, and warrant that:

  • (a) You have reached the age of majority in your jurisdiction of residence and have the legal authority to create a binding legal obligation.
  • (b) You will not permit anyone other than yourself or your authorized designate to obtain access to the Jameati Solution through your account or using your Access Information.
  • (c) You will only use the Jameati Solution in accordance with this Agreement and Applicable Law.
  • (d) You will comply with all applicable intellectual property laws in your use of the Jameati Solution and not infringe, violate, or misappropriate the intellectual property rights of any third party.
  • (e) You will comply with any educational institution’s policies and procedures applicable to your Application.
  • (f) Your Data is true, accurate, current, and complete, and if it becomes inaccurate, you will promptly notify Jameati or update Your Data on the Jameati Solution.
  • (g) To the extent that you engaged a Recruiter to provide Your Data on your behalf for the purposes of using the Jameati Solution, that the Recruiter has a legitimate educational interest in access to your educational records and information.
  • (h) You will not solicit any immigration or visa-related advice from a Recruiter unless you have confirmed that the Recruiter complies with Applicable Law in the country to which you are applying and, if required, confirming that the Recruiter has a registration pursuant to such Applicable Law.
  • (i) You will not pay any fee or other consideration to unauthorized Recruiters for immigration or visa-related advice unless they have confirmed to you that they are qualified under Applicable Law.
  • (j) You will be solely responsible for all activities with respect to the Jameati Solution undertaken by you or your designates.
  • (k) You will not use the Jameati Solution to provide commercial services to, or for the benefit of, any third party.
  • (l) You have the right and authority to enter into this Agreement, to grant the rights and licenses referred to in this Agreement, to use the Jameati Solution, and to post or upload any content to Jameati’s website or otherwise provide such content and Your Data to Jameati.
  • (m) You have all legal rights necessary to use the Jameati Solution, both in the jurisdiction in which you are located and in the jurisdiction where the educational institution you are applying to is located.
  • (n) You are not located in a country that is subject to any government embargo or sanctions that would prevent you from becoming a student.
  • (o) You are not listed on any government lists of prohibited or restricted parties.
  • (p) You agree to obtain all authorizations necessary from all third parties for your use of any third-party data in conjunction with the Jameati Solution.
  • (q) You will ensure that your use of the Jameati Solution does not interfere with, degrade, or adversely affect any software, system, network, or data used by any person, including Jameati and other users of the Jameati Solution.
  • (r) You will not use the Jameati Solution to commit or attempt to commit a crime or facilitate the commission of any crime or other illegal or tortious acts.
  • (s) You will not interfere with or compromise any of Jameati’s security measures.
  • (t) You will not alter, modify, delete, or otherwise interfere with any Content or features accessible through the Jameati Solution.
  • (u) You will cooperate with Jameati and provide information requested to assist in investigating or determining whether there has been a breach of this Agreement or Applicable Law.
  • (v) You will comply with the terms and conditions of any agreements entered into between you and any third party (including educational institutions and service providers).
  1. Restrictions and Limitations on Your Use of the Jameati Solution

(a) Access to Programs

You acknowledge that only certain educational institutions have agreements with Jameati to enable you to make an Application through the Jameati Solution.

(b) Usage Policies

The Jameati Solution will be subject to the usage policies as provided to you by Jameati from time to time, including in electronic form by posting on Jameati’s website.

(c) Equipment

You are solely responsible for the selection, implementation, installation, maintenance, and performance of any and all equipment, software, and services used in conjunction with the Jameati Solution, except for Jameati’s systems.

(d) Data Integrity and Backup

You acknowledge and agree that Jameati cannot guarantee data integrity, and that it is solely your responsibility to back up any of Your Data that you use in conjunction with the Jameati Solution.

(e) Not for Time-Sensitive Applications

The Jameati Solution is not developed or licensed for use in any inherently dangerous, time-sensitive, or mission-critical manner.

(f) Restrictions on Jameati Website Use

You will not:

  • (i) Copy, reproduce, modify, enhance, improve, alter, reverse engineer, disassemble, deconstruct, translate, decrypt, reverse compile, or convert into human-readable form the Jameati Solution, or any part thereof.
  • (ii) Distribute, assign, license, sublicense, lease, rent, transfer, sell, or otherwise provide access to the Jameati Solution to any third party.
  • (iii) Remove, deface, cover, or otherwise obscure any proprietary rights notice or identification on the Content.
  • (iv) Use the Jameati Solution in any way inconsistent with the use parameters.
  • (v) Attempt to hack the Jameati Solution or any communication initiated by or made through the Jameati Solution.
  • (vi) Collect any information or communication about the users of the Jameati Solution by monitoring or intercepting any process.
  • (vii) Use any type of bot, spider, virus, or other codes or instructions designed to provide unauthorized access to the Jameati Solution or that are designed to monitor, distort, delete, damage, or disassemble the Jameati Solution.
  • (viii) Authorize, permit, or otherwise acquiesce in any other party engaging in any of the activities set forth in this Section 8.
  1. Changes to Terms and Conditions; Changes to Jameati Solution; Right to Edit and Remove Your Data; Suspension or Termination

(a) Changes to Terms and Conditions

Jameati reserves the right to change these Terms and Conditions at any time without notice. Your continued access to or use of the Jameati Solution after any changes indicates your acceptance of such changes. It is your responsibility to review these Terms and Conditions regularly.

(b) Changes to the Jameati Solution

Jameati reserves the right to change, suspend, or discontinue the Jameati Solution at any time, including the availability of any Content, without notice.

(c) Right to Edit and Remove Your Data

Notwithstanding anything to the contrary herein, Jameati reserves the right to review Your Data stored on its servers to verify your compliance with this Agreement. Jameati has the right to edit or remove any of Your Data that it believes may be unlawful, obscene, abusive, or otherwise objectionable.

(d) Suspension or Termination

Jameati may impose limits on the Jameati Solution or terminate or restrict your access without liability. Where feasible, Jameati will provide you with advance notice of such changes.

Jameati reserves the right to revoke your access for any abusive conduct or fraudulent use and to cease the Jameati Solution temporarily or permanently if your use constitutes a threat or breach.

Without limiting other remedies, Jameati may limit your activity, issue a warning, temporarily suspend, indefinitely suspend, or terminate your account and refuse to provide the Jameati Solution to you if:

  • (i) You breach this Agreement.
  • (ii) Jameati is unable to verify or authenticate any information you provide.
  • (iii) Jameati believes that your actions may cause financial loss or legal liability.

(e) Investigations

Jameati reserves the right to investigate suspected violations of this Agreement. You will cooperate with Governmental or Regulatory Authorities, educational institutions, and system administrators in such investigations.

  1. Your Obligation to Report Errors

You will promptly report to Jameati any actual or apparent errors, problems, or other difficulties with the Jameati Solution, along with any other information reasonably requested to aid in resolving such issues.

  1. Submissions

Any suggestions, bug reports, or other communications respecting the functionality of the Jameati Solution or website that you transmit to Jameati by any means (each, a “Submission”), are considered non-confidential and may be used by Jameati or any third party without compensation or liability to you.

You hereby grant Jameati a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, distribute, transmit, modify, develop, and prepare derivative works of any Submission.

  1. Fees, Payment, and Taxes

(a) Fees

You will pay all applicable fees in connection with the Jameati Solution, as set forth on Jameati’s website or as otherwise provided to you. Fees are quoted and payable in UAE dirhams unless otherwise specified.

Jameati may require you to pay an Application processing deposit depending on various factors. Details regarding the Application processing deposit and applicable countries may be viewed on the Jameati website and may be changed from time to time. Situations where an Application processing deposit will not be returned include:

  • (i) Failure to provide the required documents.
  • (ii) Rejection of your visa application.
  • (iii) Cancellation of your Application before an admission decision is received.

Certain fees charged are set by educational institutions or third parties, and payment obligations are therefore non-cancellable and fees paid are non-refundable.

(b) Fee Payment

Where you pay fees by means of a credit card, you authorize Jameati or its third-party payment processor to automatically charge you for any fees incurred. If your credit card is rejected, you will be responsible for any associated fees and charges.

(c) Interest on Late Payments

Jameati will be entitled to charge interest on all outstanding amounts at the lesser of 1.5% per month or the maximum rate permitted by Applicable Law.

(d) Taxes

You are responsible for, and will pay, all taxes relating to this Agreement, excluding any taxes based on the net income of Jameati.

  1. Confidential Information

(a) You must keep the terms of this Agreement and all information provided by Jameati confidential, except as required to perform the Services.

(b) You acknowledge that you may be exposed to Confidential Information.

(c) At all times during and after the term of this Agreement:

  • (i) You will maintain all Confidential Information in strict confidence.
  • (ii) You will not use, disclose, or reproduce the Confidential Information except as reasonably required.
  • (iii) You will advise Jameati immediately of any misuse of Confidential Information.

(d) Jameati will use reasonable commercial endeavors to safeguard Your Data and keep it confidential, while in Jameati’s control.

(e) The non-disclosure obligations will not apply to information which:

  • (i) Is publicly available.
  • (ii) Was disclosed to you lawfully by a third party.
  • (iii) Was lawfully known to you prior to receipt.
  • (iv) Was independently developed without reference to Confidential Information.

(f) You will immediately return to Jameati all Confidential Information upon request or termination of this Agreement.

(g) Damages may not be an adequate remedy, and Jameati will be entitled to obtain relief by way of injunction.

  1. Intellectual Property

The Jameati Solution is owned by Jameati or its licensors, who retain all right, title, and interest therein. The Jameati Solution is protected by intellectual property laws. You do not acquire any intellectual property or other proprietary rights under this Agreement.

  1. Term and Termination

(a) This Agreement commences upon your acceptance of these Terms and Conditions on the Jameati website.

(b) Either Party may terminate this Agreement for any reason, without cause, upon 30 days’ written notice.

(c) Jameati may terminate this Agreement immediately upon notice for cause if:

  • (i) You commit a material breach and fail to rectify it within 30 calendar days.
  • (ii) You commit a breach of any of your representations.
  • (iii) Jameati is prevented from providing any portion of the Jameati Solution due to your acts or omissions, acts or omissions of a third party, or any Applicable Law.
  1. Effect of Termination or Expiry

(a) Upon termination or expiry, you must cease all use of the Jameati Solution.

(b) Termination or expiry does not affect your payment obligation for any fees accrued.

(c) Termination does not affect any accrued rights or remedies of either Party.

(d) Provisions which by their nature would survive termination will continue in effect.

  1. Disclaimers

(a) Disclaimer of Implied Warranties

THE JAMEATI SOLUTION, INCLUDING THE CONTENT, IS PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

(b) Your Reliance on Content

Jameati has no control over, and no duty to take action regarding, how you may interpret or use Content accessed through the Jameati Solution. Jameati assumes no responsibility for any errors or inaccuracies in the Content.

(c) Control of Third Parties

Jameati has no control over educational institutions or entities granting visas or admissions. You acknowledge that the success of your Application is solely within the control of such third parties.

(d) Rejection of Applications

Jameati is not responsible for your Application, mistakes in Your Data, or your failure to gain admission.

(e) Issues with Educational Institutions

All issues respecting Applications and Programs are between you and the educational institution.

(f) Inability to Access Country

You are solely responsible for fulfilling any entry requirements necessary to gain admission into the country where your Program is located.

(g) Service Providers

Jameati has no liability for any acts or omissions of third parties in relation to servers and data storage.

(h) Unauthorized Use of Access Information

Jameati is not responsible for any use of the Jameati Solution by any third party accessing it using your Access Information.

(i) Use for Time-Sensitive Applications

Jameati will not be liable for any claims or damages arising from such use if you use the Jameati Solution for a time-sensitive purpose.

(j) Availability of the Jameati Solution

JAMEATI WILL HAVE NO LIABILITY FOR THE TIMELINESS OR CONTINUED AVAILABILITY OF THE JAMEATI SOLUTION.

(k) Viruses

Downloading Content is done at your own risk. Jameati cannot guarantee that the Jameati Solution or the Content will be free of viruses or other harmful code.

(l) Communications Not Confidential or Secure

Jameati does not guarantee the confidentiality of any communications made through the Jameati Solution.

  1. Your Indemnities

You will indemnify, defend, and hold harmless Jameati and its affiliates from any claims, losses, damages, fines, penalties, or other costs arising out of or in connection with:

  • (a) Your access to the Jameati Solution.
  • (b) Your unauthorized use or misuse of the Jameati Solution.
  • (c) Your breach of this Agreement.
  • (d) The infringement by you of any intellectual property or other right of any third party.
  • (e) Your violation of any Applicable Laws.
  1. Limitation of Liability

(a) To the maximum extent permitted under Applicable Law, Jameati will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.

(b) In no event will the total aggregate liability of Jameati exceed 1,000 UAE dirhams.

(c) Nothing in this Agreement limits Jameati’s liability for fraud or personal injury caused by its negligence or willful misconduct.

(d) The limitations specified will survive and apply even if any limited remedy fails of its essential purpose.

  1. General

(a) Force Majeure

Neither Party will be liable for delays caused by events beyond its reasonable control.

(b) Contracting Status

Nothing creates a joint venture, partnership, principal-agent, or employment relationship between the Parties.

(c) Notices

Notices will be in writing and sufficient if delivered by hand, registered mail, courier, or email.

(d) No Waiver

No waiver of a breach will be binding unless made in writing.

(e) Severability

If any provision is held invalid, the remainder of the Agreement will remain in effect.

(f) Governing Law

This Agreement will be governed by the laws of the United Arab Emirates. You consent to the exclusive jurisdiction of the courts in Abu Dhabi.

(g) Entire Agreement/Modification

This Agreement constitutes the entire agreement and may not be altered except by a written instrument signed by both Parties.

(h) Electronic Agreement

By clicking “I AGREE,” you are entering into a legally binding contract. You agree to the use of electronic communication for all transactions and notices.
